Terms and Conditions
§ 1 Provider and scope
The provider of the "Echoes of Love" service is Portal Minds UG (haftungsbeschränkt), Teichtal 12, 38165 Lehre, Germany ("we"). These terms apply to all contracts between us and the user ("host") who creates a tribute project.
§ 2 Description of service
Echoes of Love enables the collection of voice messages via a shared invite link and the assembly of those messages into a single audio file. The service is provided as a web-based application; no installable app is required.
§ 3 Conclusion of contract and price
The contract is concluded as soon as the host unlocks a tribute project and the one-time payment of USD 59 has been successfully processed via our payment provider Stripe. The unlock applies to exactly one tribute project.
§ 4 Right of withdrawal for consumers
Consumers generally have a 14-day right of withdrawal. As Echoes of Love provides digital content with immediate availability, the right of withdrawal expires pursuant to § 356 (5) BGB once we have begun execution after the host has expressly consented and acknowledged that this consent causes the loss of the right of withdrawal. The host gives this consent during checkout.
§ 5 Host obligations
The host warrants that they are entitled to use the data of the deceased person and any photos or music uploaded, and that they have informed contributors about the processing of their voice recordings. The host indemnifies us against third-party claims arising from a breach of these obligations.
§ 6 Contributor content
Before submitting, contributors expressly consent to their voice recording being included in the tribute. Unlawful, abusive, or copyright-infringing content may not be uploaded.
§ 7 Availability
We strive for the highest possible availability but do not owe uninterrupted accessibility. Maintenance and force majeure may lead to temporary restrictions.
§ 8 Liability
We are liable without limitation for intent and gross negligence and for damages arising from injury to life, body, or health. Otherwise, in the case of slight negligence we are liable only for the breach of essential contractual obligations and only up to the foreseeable damage typical for the contract.
§ 9 Final provisions
The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. Should individual provisions be invalid, the validity of the remaining provisions remains unaffected.
